To use Shakti-IMS, you must have the legal authority to enter into these Terms of Service — either on your own behalf or as an authorised representative of an organisation.

Each user is responsible for maintaining the security of their account and for all activities conducted under it. Specifically, users are responsible for:

Shakti-IMS may only be used for lawful recruitment and interview management purposes. The following activities are strictly prohibited:

Organisations that use Shakti-IMS retain full ownership of the candidate and recruitment data they upload to the platform. Your data belongs to you.

You are responsible for ensuring that any data you upload to Shakti-IMS has been collected and may be processed in accordance with applicable data protection laws, including obtaining any necessary consent from candidates.

All intellectual property within Shakti-IMS belongs exclusively to Shaktisquad Infotech Solutions Pvt. Ltd. This includes, but is not limited to:

• All software, source code, and algorithms
• User interface designs and visual assets
• Branding, trademarks, and trade names
• Documentation, help content, and training materials
• AI models and related technology

Where a paid subscription plan is applicable, the following terms govern your billing relationship with us:

• Advance payment — Subscription fees are payable in advance, prior to each billing period.
• Non-refundable — Fees paid are non-refundable unless otherwise expressly agreed in writing by Shaktisquad.
• Auto-renewal — Subscriptions renew automatically at the end of each billing period unless cancelled at least 7 days in advance.
• Payment failure — Failure to pay on time may result in suspension or termination of your access to the platform.
• Price changes — We reserve the right to modify pricing with reasonable advance notice. Continued use after the effective date constitutes acceptance.

We strive to maintain high availability of the Shakti-IMS platform, but we do not guarantee uninterrupted, error-free service at all times.

• Scheduled maintenance windows will be communicated in advance through the platform or by email where possible.
• Unforeseen technical issues, infrastructure outages, or third-party service failures may temporarily affect access.
• We will make reasonable efforts to restore service promptly and keep users informed during significant outages.

Temporary service interruptions do not entitle users to refunds or fee credits unless expressly provided for in a separate service level agreement.

While Shaktisquad implements industry-standard security measures to protect the platform, users also have important security responsibilities:

• Secure credentials — Keep your login credentials strictly confidential and do not share them.
• Strong passwords — Use strong, unique passwords and update them regularly.
• Device security — Ensure that devices used to access the platform are secured with up-to-date software.
• Incident reporting — Notify us immediately at security@shaktisquad.com if you suspect any unauthorised access or security incident.

Both Shaktisquad and its customers agree to maintain the confidentiality of any proprietary or confidential information disclosed in the course of using the platform.

Confidentiality obligations do not apply to information that is publicly available, independently developed, or required to be disclosed by law.

To the maximum extent permitted by applicable law, Shaktisquad Infotech Solutions Pvt. Ltd. shall not be liable for any of the following:

AI-powered features — including resume parsing, interview question generation, assessment scoring, and candidate recommendations — are provided as decision-support tools. Final hiring decisions remain the sole responsibility of the organisation and its authorised users.

Shaktisquad reserves the right to suspend or terminate access to Shakti-IMS in any of the following circumstances:

• Breach of Terms — A user or organisation violates any provision of these Terms of Service.
• Fraudulent activity — Fraudulent, abusive, or deceptive conduct is detected on the account.
• Non-payment — Required subscription payments remain unpaid beyond the grace period.
• Legal obligation — We are required by applicable law or a court order to do so.

Upon termination, your access to the platform will be suspended. You may request an export of your data within 30 days of termination, after which data may be permanently deleted in accordance with our retention policy. Termination does not relieve you of any outstanding payment obligations.

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of India, including the Information Technology Act, 2000 and applicable rules thereunder.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India. Both parties agree to submit to this jurisdiction for the resolution of any such disputes.

We may revise these Terms of Service periodically to reflect changes in our practices, legal requirements, or platform features. When material changes are made, we will notify users by:

• Displaying a prominent notice within the Shakti-IMS application.
• Sending a notification to your registered email address.
• Updating the "Effective Date" and "Last Updated" fields at the top of this page.
